Frequently Asked Questions
Short answers to common questions about this provision. They are general information and not legal advice.
It empowers the Commission to adopt implementing acts of general scope specifying the arrangements for the exchange of information by electronic means between supervisory authorities, and between supervisory authorities and the Board. The provision addresses the technical machinery of cooperation, not its substance.
Article 67 mentions in particular the standardised format referred to in Article 64, that is, the electronic form in which supervisory authorities and the Board communicate information within the consistency mechanism, as reflected in Article 64(4).
They must be adopted in accordance with the examination procedure referred to in Article 93(2), which means the Commission acts with the involvement of the committee established under Article 93, composed of representatives of the Member States.
No. The implementing acts may only specify arrangements for exchanging information electronically and must be of general scope, so they cannot direct how the cooperation procedure of Article 60 or the dispute resolution of Article 65 is decided in an individual case.
The cooperation and consistency mechanisms of Chapter VII depend on fast circulation of draft decisions, objections and opinions across all Member States, and Articles 60(12) and 64(4) already prescribe standardised electronic formats. Article 67 provides the legal basis for harmonising the technical arrangements so that these exchanges work uniformly across the Union.
