Frequently Asked Questions

Short answers to common questions about this provision. They are general information and not legal advice.

Article 71(1) requires an annual report regarding the protection of natural persons with regard to processing in the Union and, where relevant, in third countries and international organisations. The report is a stocktaking of the state of data protection rather than an account of the Board's internal administration alone.

The report must be made public and transmitted to the European Parliament, to the Council and to the Commission, which places the Board under the scrutiny of the political institutions while informing the general public.

Article 71(2) requires the report to include a review of the practical application of the guidelines, recommendations and best practices referred to in point (l) of Article 70(1), as well as of the binding decisions adopted under Article 65. The Board must therefore evaluate how its own instruments have worked in practice.

Each supervisory authority draws up its own annual report on its activities under Article 59, addressed to its national parliament, government and other designated bodies. Article 71 creates the Union-level counterpart, focused on the protection of natural persons across the Union and on the functioning of the consistency instruments.

Only where relevant. Article 71(1) extends the report to processing in third countries and international organisations on that conditional basis, which fits the Board's tasks under points (s) and (w) of Article 70(1) concerning adequacy assessments and exchanges with supervisory authorities worldwide.
